At Pine & Palm Productions, we hold our work to a high standard. As we grow, we keep finding new ways to make booking professional photos simple. These terms and policies are our guidelines. If something isn’t covered here, just ask and our team will sort it out promptly.

In these terms, “you” means the Client who books a session, and “we” or “us” means Pine & Palm Productions, LLC.

General Policies

Booking and Confirmation

• All sessions are booked on a first-come, first-served basis, based on when we receive your Booking Fee.
• Your booking is final only once you receive a confirmation email from Pine & Palm Productions with the date and time of your session.
• Any discussion or planning before your Booking Fee (deposit) is paid is tentative until the fee is paid and you have received your confirmation email.

How We Use Your Photos

As a portrait Client of Pine & Palm Productions, you understand and agree that we may use all images taken during your session for our marketing and social media. We will never sell or license your images to any third party without your explicit consent.

If you have any concerns or requests about how we use your photos, just let us know in your consultation emails. We’re happy to work with you and adjust how we use your images so you feel comfortable.

Image & Printing Rights

All standard Portrait Package, Proposal, Elopement, Simple Ceremony and Wedding Clients have free use and printing rights to every completed image delivered in their Google Drive folder. This is included with all of our portrait packages as our way of saying “thank you” for choosing Pine & Palm Productions.

Getting the Best Prints

• Completed images are delivered at their highest resolution, ready to upload to any printer for the best-quality prints.
• For the best print quality, download your images directly from your Google Drive folder. “Copying” an image compresses the file, which can lower the quality of the print.
• We guarantee delivery of the proper digital files for printing. We are not responsible for third-party prints that you are unhappy with.

Printing with Us

You’re welcome to print back home, for example at your local Costco or Walmart, or you can order prints directly through Pine & Palm Productions. We print through a third-party fine art printer, and every print ships to your door in a strong, protective wooden case made for transporting artwork. You can rest assured that any print ordered through us will arrive free of defects and at the highest quality possible.

Weather

Maui’s weather is always changing, and it’s the hardest variable for us to plan around because no one can control it.

• If your shoot has to be canceled because of bad weather, you can reschedule with no penalty, subject to availability.
• If no other time slot is available during your travel dates, the weather delay becomes a cancellation. Your $50 Booking Fee isn’t refunded, but it carries over: you get a free rebooking for a future session, with no new Booking Fee. Your free rebooking must be used within 18 months of your original session date.
• Weather cancellations are a joint decision between you and Pine & Palm Productions.

We do our absolute best to stay flexible and adapt to every situation. Full cancellations due to weather are extremely rare.

Payments

We work with Clients from all over the world, so we do our best to make paying easy.

What We Accept

• Visa, Mastercard, Discover, JCB and American Express
• Google Pay and Apple Pay
• Cash is accepted but discouraged, since we work on public beaches and carrying large amounts of cash is a high risk. If you pay in cash, please bring exact change; we don’t provide change.

When You Pay

• Booking Fee: paid online right after you send your booking request. We hold your requested time for 24 hours (requests made after 3:00 PM Friday or on the weekend are held until 6:00 PM Monday, Hawaiʻi time); once your Booking Fee arrives, your session is confirmed by email. If it isn’t received by then, the request is released so the time can open up for others.
• Remaining balance: collected on-site after your photos are taken. We carry mobile readers for card, tap and chip payments.
• If you don’t live on Maui, we discourage paying in full ahead of time.
• There are no refunds within 14 days of your scheduled session.

Fees

Booking Fee

Every package requires a deposit to secure your session. Portrait, proposal, engagement and Elopement sessions booked online: $50, or $75 at a premium location (the $50 Booking Fee plus the $25 permit fee). Honolua Bay is booked by inquiry only and carries a $75 location fee instead of the $25 permit fee: once we confirm it for your date, we invoice the $50 Booking Fee plus the $75 location fee ($125 plus tax). See Premium locations. Services priced over $1,000 (Simple Ceremony and Wedding, booked by inquiry): 25% down. Scheduling isn’t final until we receive this payment. Your Booking Fee is applied to your package or service rate, and the rest is your balance due. The $25 premium location permit fee is separate and doesn’t reduce your balance.

Special Permits

A request to use a public location that isn’t on the State of Hawaiʻi DLNR Open & Accessible list carries a $25 fee. This covers the extra permitting needed for commercial photography or videography. (See Premium locations.)

Holiday Rates

Sessions on a major holiday carry an additional $100 Holiday Fee. Holidays include:

• New Year’s Day
• Valentine’s Day
• Easter Sunday
• Fourth of July
• Halloween
• Thanksgiving
• Christmas Eve
• Christmas Day
• New Year’s Eve

Sales Tax

All sales are subject to sales tax on top of the price of the service or product. Sales tax is charged based on your location at the time of purchase.

Cancellations & Rescheduling

Cancellation Scale

What happens to your Booking Fee depends on how close to your session you cancel:

Premium location permit fee: the $25 Premium Location permit fee is never refunded once paid, whether your session is cancelled, rescheduled or relocated for weather or conditions, because the permit has already been bought from the county. If you choose to reschedule a premium-location session, a new $25 permit fee is due for your new date (not when we move your session because of weather). On a $75 premium booking, only the $50 Booking Fee is refundable.

Honolua Bay location fee: the $75 Honolua Bay location fee is never refunded once paid either, whether your session is cancelled, rescheduled or relocated for weather or conditions. If you choose to reschedule a Honolua Bay session, a new $75 location fee is due for your new date (not when we move your session because of weather).

If your session is canceled because of weather, you get a free future rebooking instead, good for 18 months from your original session date (see Weather). Interisland travel fees follow their own refund rules (see Interisland travel).

Rescheduling

Moving your session to a new date or time does not forfeit your Booking Fee. If you choose to reschedule at a premium location, a new $25 permit fee is due for your new date, because the permit is bought from the county for a specific date (at Honolua Bay, a new $75 location fee). There's no new permit fee when we move your session because of weather. Please let us know about any schedule change at least 15 days before your session if you can, so we can avoid scheduling conflicts. New dates and times are subject to availability.

Interisland Travel

Sessions on an island other than Maui carry a flat travel fee, based on where the photoshoot takes place:

• $200: Lānaʻi
• $300: Kona (KOA) and Oʻahu (HNL)
• $375: Kauaʻi (LIH) and Hilo (ITO)

• The travel fee is in addition to the package rate you choose. To reserve an off-island session, we collect both the Travel Fee and the Booking Fee.
• If the weather doesn’t cooperate on your reserved date and time, the travel fee also covers a second session, based on our availability.
• There are no extra charges for the photographer’s travel accommodations. The remaining balance is collected after our services are complete.
• Interisland Travel Fees are non-refundable once paid, because we use them right away to purchase the photographer’s travel and accommodations.
• Travel fees can be split between multiple Clients rather than charged per booking. Ask us about it.

Locations

Mini Sessions

Mini Sessions have a limited set of locations, based on where you’re staying. Travel to locations on the DLNR’s list for Maui County is included in our rates. Mini Sessions are offered at Poʻolenalena, Polo and Launiupoko (sunrise or sunset), plus Wahikuli Beach and Kanaha Beach Park for morning Mini Sessions only.

Premium Locations

Any location not on the DLNR Open & Accessible list is a “premium location” and carries an additional $25 plus tax for the county permit needed to photograph there. The permit fee is never refunded once paid (see Cancellations & Rescheduling).

Honolua Bay

Honolua Bay is our most exclusive premium location. It carries a $75 plus tax location fee instead of the $25 permit fee, and it’s booked by inquiry only: please contact us before booking, because using this spot takes extra coordination that we need to confirm for your date. Once we confirm Honolua Bay for your date, we send you an invoice for the $50 Booking Fee plus the $75 location fee ($125 plus tax). The $75 location fee is never refunded once paid. If you choose to reschedule, a new $75 location fee is due for your new date (not when we move your session because of weather).

Approved Locations

The locations we use for photo sessions are approved by the State of Hawaiʻi Film Department and the Department of Land and Natural Resources (DLNR). Any location you request outside the available list must be pre-approved for commercial use by its owner.

Kāʻanapali Beach

We agree it’s one of Maui’s most iconic beaches, but this shoreline (both sides of Black Rock) falls under the DLNR Division of Boating and Ocean Recreation. Commercial photography isn’t allowed there, and using the area could result in a fine of up to $10,000.

Editing & Photo Delivery

Delivery Timeline

• Your online gallery is ready to view in 5–7 business days.
• Your final edited photos are delivered 14 business days after you send us your selections.
• You have 3 months from the day your proofing gallery is delivered to make your selections (see our Photo Selection Policy).

Basic Editing

Every Portrait Package includes basic editing: adjusting shadows, lighting and color, light skin softening, teeth whitening, and removing background distractions like people in the water (surfers excluded), beach clutter or any of our gear caught in the frame.

Advanced Editing

Advanced edits are requests you make in the comments while proofing your gallery. They take longer, which extends the standard delivery of your final images (14 business days after your selections). If our editor needs extra time, we’ll let you know when we confirm your final images for editing.

Discounts

Military

Pine & Palm Productions is a proud supporter of America’s armed forces. All active-duty and retired service members receive 10% off all regular-priced services and prints with valid ID. Just mention your status during your pre-shoot consultation and we’ll add your discount. Thank you to all of our service men and women who have risked their lives for our freedom.

Kamaʻāina

As a small business, we know how essential local commerce is to our company and to the community we’re building at Pine & Palm Productions. That’s why we offer a 10% Kamaʻāina discount to every member of our local community with a valid Hawaiʻi driver’s license or state ID. Just mention your residency before your session date.

Pine & Palm ʻOhana

To say “mahalo nui” for your continued support, all returning Clients receive 10% off any Portrait Package. Your Booking Fee stays at $50, and the discount comes off your remaining balance.

Discounts can’t be combined: one discount per booking.
